Will I go back to jail for drinking while prohibited to do so? - I am on probation until june 30 of 2012. I had 13 months sober until 2 nights ago when, while receiving treatment for depression in hospital, I got drunk and came back late. They administered a blood alcohol test and they said my levels were 5. I asked about my privacy rights regarding this, but the social worker on the ward still called my social worker from my home city and I am not sure if she has told my probation officer yet. I have been attending AA atleast 3 days a week, have a one hour session with a concurrent disorders counceler each week and I have followed all other terms of my order, really working hard to stay on the right path. But I have been hospitalized 3 times in the last 6 months for my major depressive disorder and it finally got the best of me the other night. I went to AA today and I have no desire to continue to drink, but I am terrified that they will put me back in jail once I am released from hosputal because there is evidence of my blood tox. I really messed up, it was a slip and i am terrified to go back there. Will I have to go infront of a judge? will I go back to jail? will it work in my favor that I have everything recorded in regards to my therepy and progress? did the hospital break my privacy issue even though I was adimant they do not release the info? are they bound by law to report? i am so terrified and I feel so utterly defeated.
